The fact of the matter, however, is that our Alberta government is (or at least should be) far more interested in hearing from ordinary Albertans about this issue than from injury lawyers or auto insurance companies. Accordingly, if you have been injured in an auto accident and believe that there should not be a government-imposed compensation cap potentially impairing your ability to be fully and fairly compensated, tell our new Premier what you think! Here’s a sample letter:
Dear Premier Kenney,
I suffered soft tissue injuries as a result of being victimized by a negligent driver in an auto accident. Unfortunately, I may be re-victimized by a regulation passed in 2004 (a regulation made even more unfair to innocent injured victims by the NDP government last year). If I had suffered a hard tissue injury (which typically heals much more quickly than many soft tissue injuries), my case would not be capped. Or if my soft tissue injury was sustained in a slip and fall accident rather than a car accident, my case would not be capped. Does that strike you as a rational regulation?
The soft-tissue injury cap drastically reduces compensation available to innocent injured auto accident victims like myself, so as to subsidize the rates of reckless drivers like the one who hurt me. Does this strike you as fair?
The Auto Insurance Rate Board has confirmed that most good Alberta motorists are actually paying higher car insurance premiums than before the cap was implemented. So who exactly is benefiting from this cap? Obviously high-risk drivers, and of course insurance companies (who have seen their profits skyrocket since the cap was enacted).
I urge your government to stand up for severely normal Albertans injured in auto accidents by repealing the Minor Injury Regulation.
